IN W OR Li ANIR: FRII)AY MARCH 22, 1_39. SSUPrneMt CovuT.-The Senate laid the nominations of R. Garland and C. Derbigny, Esqs., to be Judges of a the Supreme Court, indefinitely on the table on the last night of the session. This precludes the possibility of filling the two acnant offices in the court ty theesecu tive. It is in fact defeatirg and nullifying the law to. cently passed, inoreauing the number of judges to feve. The minority in the Senate, by waiting and watching, became the majority and carried their point. They t have done all in their power to break down the court, I and have well nigh effected it. It is not exported the two judges recently appointed to fill the vcancnies in ac the bencl will hold their commissions when they ac. cepted them on the express understanding that the bench was to consist of fie judges. If they resgn, no stil others at all qualified will take their places, and suabject themselves to the dark inquisition of the Senate, and B be smothellred in the aecet conclaves of that body, after at hwring devoted themselves to the duties of their steta i tion. pl We must say the governor hasen been extremely tardy Me in making the nominations. It was had policy to wait den until the very close of the session, when every. thing m was in conCfuson. Some apo!ogy may be found in re. lation to one of the nominees in the extraordinary con- the duct of tile Renate; but whiy were not all four sent in an together? Finally, when the two last nominations pa were made, Mr. Derbigny wue inproperly sent in as one of the nominees. He was in fact inelligible, having been a Irmbe r of te 'legislature that passed the law t reanting the ofie., e was also on tim spot and did abi not desire the ofice, wil We learn also that no district judge has been ap* pointed to the fourth judicial district, in place of the Hon. Thouma J. Cooley, resigned. Hem is a district which will be entirely without ajudge or a court for the L next twelve moaths. There has not, pi.baps, been an uti instance of such gross negligence and injustice done of' towards a district. and tile people of the State generally, inn than these movements of the Senate. op ne TE Vzro.-We cannot consent that the principle ille of the Veto is Republican. Within a few days, it has itte been exercised by the Eecutive toprevent the paseage ea of the Bill in which the community had the closeat in. terraest. Ar alil times, the riht of using the Veto power, is or queotionable. Il its use, the patriarchs of our Federal GOurernmetr, so coneidered it. Mr. Madison, when a e respectable majority manifested their saupport of a N. tional IBank, although he wae dianmetrically opposed to Ia each ani inatitution, did toe feel it his duty to forbid the Fin act establiahing the institution, although he might have exerci.cd tihe privilege. We thlik that Gayo. Roman is wrong-very, radically F. wrong, and we only ask for him to give the subjett his Eahl relectinn to conviace him of his attitude. i. In place of our own reflections which we shall give, we awford room to the addresses on the m asubject by memhers of the HolueM. To-:norrow, we shall pursue t our invesatigation, fairly and without extenuation. . Why i(floer'nor Roman like ll article monnpolired by a tingile merchn nt I D'ya give it up ?
